About Blaney Harper
Blaney Harper's practice focuses on strategic patent litigation representing electronics, software, and information technology companies in matters such as patent enforcement in United States District Courts and the International Trade Commission (ITC). Blaney also represents and counsels clients concerning patent portfolio development and patent prosecution and appeal, including Inter Partes Review, in the USPTO. The Federal Circuit's 2017 decision in TC Heartland has created a paradigm shift on how litigants in patent cases choose a venue. For decades, patent holders were allowed to sue for infringement in almost any federal district court wherever personal jurisdiction could be established, allowing non-practicing entities (NPEs) to choose venues that would create heavy pressure on defendants to settle and avoid costly litigation. However, with the recent court decision, patent litigation cases have been limited to districts in states where the defendant is incorporated or has a regular and established place of business only.
