About Marshall Baker
Mr. Baker concentrates his practice on complex commercial litigation, with an emphasis on multistate class action defense involving claims for consumer fraud, product defects, and false and deceptive advertising. Mr. Baker has substantial experience litigating cases in state and federal courts for clients in a range of industries, including automotive, communications, consumer electronics, pharmaceutical and retail. He has defended numerous class actions involving claims for false advertising, unfair competition, consumer fraud, breach of warranty and product defects. Mr. Baker also has extensive experience litigating complex product liability cases, primarily involving pharmaceutical products and medical devices.
Mr. Baker received his J.D. from the University of California, Davis School of Law, where he was elected into the Order of Barristers. He received his A.B. with highest honors from the University of California, Davis.

As restrictions and interpretations of what constitutes an Automatic Telephone Dialing System (ATDS) remain ambiguous, companies that do business through telemarketing become more prone to class action lawsuits filed under the Telephone Consumer Protection Act (TCPA).
Recently, the Ninth Circuit released its statutory definition of ATDS as an “equipment which has the capacity – (1) to store numbers to be called or (2) to produce numbers to be called, using a random or sequential number generator – and to dial such numbers” setting aside the prior interpretation made by the Federal Communications Commission (FCC).
Until the FCC releases its final ATDS guidance and definition, businesses may be faced with profound compliance hurdles. Thus, keeping themselves abreast with recent developments, policies, and risk mitigation strategies to overcome potential challenges become more imperative.
