SGS summarizes EPA proposal to modify certain TSCA prohibitions on two flame retardants

SGS publishes SafeGuardS on EPA proposed to modify certain prohibitions on PIP (3:1) and DecaBDE under TSCA 40 CFR 751.
SGS, the world’s leading, testing and certification company, has published SafeGuardS 161.23 to keep stakeholders informed about proposals by the U.S. Environmental Protection Agency (EPA) to modify prohibitions on the flame retardants phenol, isopropylated phosphate (3:1) (PIP 3:1) and decabromodiphenyl ether (decaBDE).

The EPA original published final rules relating to five persistent, bioaccumulative and toxic (PBT) chemicals under Section 6(h) of the Toxic Substances Control Act (TSCA) in January 2021. In addition to PIP (3:1) and decaBDE, these restrictions related to
• 2,4,6-Tris(tert-butyl)phenol (2,4,6-TTBP)
• Pentachlorothiophenol (PCTP)
• Hexachlorobutadiene (HCBD)

The EPA released a proposed rule on November 21, 2023, to update provisions relating to PIP (3:1) and decaBDE. Changes would include new phaseouts and workplace requirements, as well as extended compliance deadlines for certain critical applications.

SGS publishes SafeGuardS to keep stakeholders informed about regulatory and market changes that may impact their business. SafeGuardS 161.23 details these proposed changes and includes highlights of the modifications for both PIP (3:1) and decaBDE.

Stakeholders are advised to review SGS’s original SafeGuardS 161.23 for more information, including the final date on which the EPA will accept comments.
